TERMS AND CONDITIONS
PAYMENTS AND PRICING
All prices apply on the condition that any orders on which prices are based do not change. Any costs caused by changes made by the customer will be charged in addition to any quoted prices.
Unless otherwise agreed, our terms of acceptance require a 50% deposit payment of the gross total cost at time of order, with the balance due for payment on completion. Account holders are required to pay Stratford Print the amounts calculated with reference to the invoice within 30 days of the invoice date unless other terms have been agreed.
If any invoice remains unpaid after the due date, Stratford Print reserve the right to charge interest at 5% prevailing from the date on which such amounts become due until payment is made in full.
Stratford Print reserve the right to hold goods until payment has cleared through the bank and reserve the right to request full settlement for work on collection.
The client will pay any expenses incurred by Stratford Print in connection with the recovery of monies outstanding (including all legal costs). All prices are quoted exclusive of VAT, which will be applied to all invoices at the prevailing rate where appropriate.
PRINT AND PROOFING
Any artwork and design carried out by Stratford Print at the customers request shall be quoted and charged for, whether experimental or otherwise. Proof of all design work will be submitted to the customer for approval and must be checked for content and accuracy. Stratford Print will incur no liability for any errors not corrected by the customer. Customers subsequent requests for design alterations and additional proofs may be charged extra.
In the case of full colour printing, we can convert images, pdfs,and artwork not sent in CMYK mode, but such conversion will be at the customers risk. Conversion of RGB data or ICC colour profiles will naturally result in deviations in colour from the original and liability for these deviations will not be the fault of Stratford Print.
Customers are advised that pdf proofs, when viewed on screen or printed off, are not 100% colour accurate and there may be some variation in colour due to lighting effects and paper specifications.
WORK THAT HAS NOT BEEN COLLECTED
If any items of work including prints and original files belonging to a client are not collected after 1 year of the requested work being finished, Stratford Print reserve the right to dispose any material.
COPYRIGHT, RIGHTS AND CONSENTS
Stratford Print claims no copyright in material submitted to us for the purposes of fulfilling the clients instruction. The client warrants that the client owns or controls all rights, has obtained all copyright, or has permissions, consents and waivers that as are now and hereafter required for all copying, processing, scanning, printing and manipulation to be undertaken by Stratford Print Ltd.
The customer also warrants that no copyright or moral rights will be infringed by Stratford Print carrying out the requested work. The customer agrees to indemnify Stratford Print. against all losses, damages, claims or expenses which Stratford Print. may incur by virtue of any breach of the above warranties. Customers should obtain the consent of any adult or, in the case of children, from the guardian or parent of the child, for the use, re production and/or printing of any photograph featuring that person. Stratford Print cannot be held liable for any infringement of privacy, or any damages arising from, the use of such photographs.
Ownership of the final artwork becomes the full property of the client upon payment of all fees. Stratford Print will retain ownership of all materials and design concepts not used in the final design. This includes layered photoshop files, illustrator files, Quark, InDesign files etc which remain our intellectual property and cannot be released to the client unless explicitly negotiated. For copyright reasons fonts used within a project cannot be released either. Under copyright law, the design company is the owner of all files and artwork created for the customer, and the customer is the owner of the end product (i.e. a printed business cards). Release of electronic files to the client is at the discretion of Stratford Print. Copyright ownership may be transferred to the client for a fee that is based on the uses for which rights are being transferred. All proofs, either hardcopies or electronic will remain the property of Stratford Print and must not be used in any form or print until the customer has paid the full outstanding balance for their work.
Graphic design and artwork is billed for the time and expertise of our professional graphic designers and artworkers and In accordance with industry standards, Stratford Print charges for design and artwork services at £1 per minute unless a fee has been negotiated beforehand. Stratford Print will not re-touch, alter or improve any artwork, graphics or pictures unless specifically asked to by the customer, upon which our harges will apply.
LIABILITY
Obvious defects in delivered or collected goods must be reported to us within 7 working days of receipt. Slight deviations in colour will not be regarded as defects. Where it is mutually agreed that sub-standard work should be reprinted in whole or part, the client should arrange for all items to be returned, completely in unopened boxes. The use by the client of any items which he/she regards as sub-standard will be deemed by Stratford Print as acceptance by the client that the item is fit for use and full repayment will be expected.
Stratford Print's liability to the client or any other party for the loss including theft, or destruction or damage to any materials provided by the client which are deposited with Stratford Print for whatever reason;- Will be limited to the replacement cost of the actual material and; Stratford Print will not be liable for the cost of reshooting or reprinting the material contained on the material and; stratford Print will not be liable for any loss or damage to the client or any other party including loss of income and; It is the clients responsibility to insure against such loss and damage.
Stratford Print will not be liable for failing to complete any contract between Stratford Print and the client due to circumstances beyond Stratford Print control including loss of power supply, machine breakdown, loss of materials, fire, storm, flood, act of god, war, civil disturbance or terrorism.
CANCELLED WORK
Any cancellations will be discussed at the time of cancellation with the client. If the work has not yet commenced the order can be cancelled and the client will not incur any cancellation costs and any deposits can be refunded within 48 hours. For orders which have been started and are already in production a cancellation cost will be discussed and any design time and materials up to the point of cancelling must be covered. Payment for any cancellations will be due as per your payment terms. Any cancellations made without notifying Stratford Print will be billed for after a period of 30 days from the work being booked onto our system.
BACK UP OF WORK
Whilst Stratford Print shall use its reasonable endeavours to ensure that backup copies of the Client's data contained are made at reasonable intervals, the Client shall be solely responsible for the backup of such data and Stratford Print shall not be liable for any damages, loss, costs or other expenses arising out of or in connection with any loss of data by the customer which are due to the failure of the customer or Stratford Print to back up such data. All artwork will be held on file for 5 years after which, if not used within this time, then said artwork will be securely deleted.
